Controlling Police Through Litigation Essay

Police departments draft and implement policies and procedures to provide consistency and eliminate ambiguity in department practices. These are guidelines are for staff and officers to follow in a variety of different situations. Police policies and procedures may have the force of law, or be considered by a court or jury in determining whether an officer acted lawfully in the line of duty. Procedures related to employee actions can also be subject to legal scrutiny in some cases. A lack of policies on issues involving the community may result in unlawful and inconsistent police action. These adverse actions can create a negative reaction within the community, and open the police officers within the department to legal liability. Michael Lyman quoted Section 1983, â€Å"Every person under color of any statute, ordinance, regulation, custom, or usage of any state or territory, subjects, or causes to be subjected, any citizen of the United States or any other person within the jurisd iction thereof to the depravation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law, suit in equity, or other proper proceeding for redress.† (pg. 270) Basically, this means that police officers are prohibited from violating any person’s civil rights. Section 1983 is a tool for a citizen to use to sue another for a violation of civil rights. Some elements must be met in order to be subject to liability through Section 1983. First, he questionable liability or violator of Section 1983 must be a â€Å"person†. A police department, state agency, or other legal entity, cannot be subject to liability under the statute. Second, the liable â€Å"person† must have been acting under the color of authority when the accused violation took place. A police officer who unlawfully beats a suspect in the commission of an arrest would be acting under the color of law. Finally, the accuser does not have to prove that the â€Å"person† intended to deprive him/her of their Constitutional rights, but only that there was a deprivation. For example, a subject who was beaten by a police officer can sue that officer for excessive force, without proving it was the officer’s intention to violate his rights, but only that the officer intended to beat him. In some cases an officer’s supervisor can be held liable because he/she is responsible for the negligence of that officer. This is known as vicarious liability, or â€Å"imputed negligence† (freedictionary.com). For example, a gang member who shoots and kills another person during a hold-up is responsible for the murder, but other gang members may be held vicariously liable for the same murder. There are several different types of defense for civil suits, and also persons who are immune to the liability in question. There are three types of immunity, they are: absolute immunity, quasi-judicial immunity, and qualified immunity. Michael Lyman lists judges, prosecutors, and legislators, as those who enjoy absolute immunity during civil liability suits (Lyman pg. 272). Lyman also reminds us that police officers and witnesses can obtain absolute immunity while testifying during a criminal trial, but if found providing false testimony, may be charged with perjury. Persons within a department, performing his/her duties as assigned, during the alleged time of a Section 1983 violation, and not involved in the violation, obtain quasi-judicial immunity. Quasi-judicial immunity is provided to prosecutors who are actively involved in the trial of a person. Qualified immunity is provided to federal law enforcement officials who are accused of violating laws that have not been clearly established. If a question of liability arises, but a federal law enforcement official is later found to be acting in an â€Å"objectively reasonable manner† he/she obtains qualified immunity (Lyman pg 273). The Advantages of My Apartment

A new family moving into the Vista community would have a plethora of housing options. There are just so many flashy ads and advertisements around. It can make finding a place to call home a true chore. But as many families have already found out, there are many reasons as to why the apartments in my neighborhood are some of the most sought after in Vista, CA. Especially in comparison to my previous residences such as Marine Corps barracks, my current apartment has many advantages that would make it a wonderful place any family would be proud to call home. First of all, for its size, the apartment is very affordable. During my 3 months of apartment shopping, I could not find a more sizeable apartment for the price I pay. It is only twelve-hundred dollars per month for two bedrooms and two bathrooms when some other properties charged nearly that price for a studio or single bedroom unit. Also, the rooms in the apartment are very large. We have a large master bedroom, and the guest bedroom is big enough for my wife and I to store all of our extra belongings as well as a twin bed and a computer workstation. In addition to those, my apartment also has an immense amount of storage space. There are walk-in closets in both bedrooms, extra storage outdoors, and there is even a walk-in pantry in the kitchen. Although, as much of a selling point the size and price were, if not for the great location, we still may have kept searching. Secondly, the apartment is in a great location. For one, it is very close to the business district. We are within a few miles of many grocery stores, shopping centers, movie theatres, and many other attractions. Also, it is within walking distance of several public transportation hubs. The buses and trains at these places travel all over, to San Diego and Los Angeles and everywhere in between. Another example of the apartments’ great location is that we are close to our friends. We live only minutes away from many of our friends. Furthermore, since we only have 1 vehicle, my wife can always simply call a friend if she needs to run errands or shop, due to the fact that we live so close together, so as not to cause a hassle. Another huge advantage of my apartment is the level of tranquility it retains. A third advantage my apartment has is how tranquil it is. One reason these apartments are so peaceful is the fact that there are no pets. Since pets are not allowed, the apartments are always almost eerily quiet. This is great because on could sleep however long they want to without being rudely awoken. Also, we do not have to worry about barking or other animal sounds interruption my television watching, music listening or whatever else I may be doing. Another reason for the tranquility of the apartment is due to the face that there are very few young children. This is nice because my wife and I have no children with the other young couples around us. Moreover, we do not have to worry about the cries of little children disturbing us during whatever we may be doing at the time. Going hand in hand with the tranquility of the apartment though, is how helpful and courteous our neighbors are. A fourth reason my apartment is advantageous is that my neighbors are very courteous and friendly. One example of this is how our neighbors always have helped us when we were in a bind. On one occasion, the battery in my car suddenly died and one of my neighbors unselfishly dropped everything he was doing and drove his car to mine to give my battery a jump start, enabling me to go to the store to buy a new battery. Also, on many occasions, our neighbors have taken our wet clothes from the community washers and changed them over to the dryers, alleviating us of having to do the task ourselves. In addition to how helpful our neighbors are, they are also quite courteous. As far as the adults around us, while they do listen to music and other things like most, they do not listen to it at absurdly loud levels so as to disturb the people around them. Furthermore, the few children that live around us are obedient and do not cause excessive noise when they play. But at any rate, even with all these upsides, I would have never chose my current apartment if not for how good and kind the management is. Lastly, an advantage our apartment has is how kind and efficient the management of our apartment is. First off, our management is very kind. They know the tenants by name . Even from the day we first picked up our house keys from the office, the people inside welcomed us by name, which was very reassuring to us. Also, whenever we pass by one of the managers, they always greet us. Though, most importantly to me, the management always address our complaints expediently. For example, when my wife and I first visited our apartment before we moved in, we had to complete a pre-occupancy checklist. While there were not many discrepancies, the few that we did note were fixed before we even started moving into our new home. Even since then, all of the problems that have arisen in our apartment such as; burnt-out light bulbs, faulty appliances, broken hot water heaters, and so on; were addressed immediately. Finally, at our apartment complex, every tenant has assigned parking spots only for our vehicles. On multiple occasions, I would find other peoples’ cars parked in my spot. All I needed to do was inform the management of someone in my spot, and the problem was taken care of right away. As you can see, my apartment has a lot going for it. All these reasons like; a good location, the level of tranquility, its’ roominess, the friendliness of the neighbors, and the quality of the management, make for a wonderful neighborhood, and a great place to bring your family home. Now, having been educated, the choice of where to call home should be quite simple. I gladly made mine, and have not regretted it for an instance

The capability of the formal research consists of contributions to the academic world and the scholarly work while capability of a business proposal is to find solutions to business problems. Despite the many differences between business proposal and research project, there are some commonalities. One of them is that the findings in both cases may or may not be presented with headings and subheadings (Bazerman, M. H., & Moore, 2009). Business proposal and formal research should work together. If no formal research is present , the proposal will be useless. To write a business proposal, there is a need to conduct a formal research on the market. The reason it is so important is that the viability of the business can be determined. It wouldn’t be logic to initiate any kind of business if the products or services are not needed by the visualized market. Business decisions require intelligence and how research can provide that intelligence. Business proposals contextualize the findings from formal research in an existing organizational structure.

Many of these people were young single women who were oblivious to the peril and dangers of the big cities they hoped to make their homes. Jane Addams, founder of Chicagos Hull House, wrote, Never before in civilization have such numbers of young girls been suddenly released from the protection of the home and permitted to walk unattended upon the city streets and to work under alien roofs. Her statement points to the status of women in America at the time. Women were going through a conversion; they were trying on new roles in their newly crafted world and leaving behind old ones. They were sheltered and protected and treading on alien territory when they left their homes. Clearly this was not the life most women were used to living; venturing out into the world was not something that was generally accepted as normal behavior. But like all else, things were changing and in the name of progress women were changing too. They found work as seamstresses, weavers, typewriters and what not. All jobs which had a man in charge or above them. Simply put they were to be the nurses, and not the doctors. The men who hired them were thought of, in that era, as noble characters. There were also those with less than noble intentions. During the summer of 1890, a warning was placed in the help-wanted section of the Chicago Tribune, cautioning female stenographers stating our growing conviction that no thoroughly honorable business-man who is this side of dotage ever advertises for a lady stenographer who is a blonde, is good-looking, is quite alone in the city, or will transmit her photograph. All such advertisements upon their face bear the marks of vulgarity, nor do we regard it safe for any lady to answer such unseemly utterances. The warning was placed in the Chicago Tribune by the First National Bank. Stepping into new shoes The women were now living lives designed for men. The city was not the same as it once had been. While there were good men keeping the honor of the city intact, there was no shortage of those who were ever ready to plunder it. There were large amounts of deaths, many of them were unknown men and women who were never identified and never saw their families again. One did not have to be murdered in Chicago; the city itself killed many in multiple accidents, you could simply step off a curb and get hit by a car and die. And of course there were the homicides. During the first half of 1892 Chicago was witness to nearly eight hindered homicides. The once innocent city was being turned into a vicious place. Chicago was turning out to become one of the dangerous cities to come out the United States of America. The streets were no longer safe and amidst dreams of becoming the best in the world, the greatest, the city did quite the opposite. Criminals Women now rose to a new status. They moved from being caregivers in the home, from being protected and sheltered, to being city girls making it on their own. And they then went from city girls to murdering harlots. Many incidences occurred where men killed women and women turned around to kill other men. Chicago was one big cesspool of criminal activity.   The criminal activity rose around the entirety of the nation, but Chicago stood out in its numbers. The 1888 killing spree courtesy of Jack the Ripper had the nation enthralled and addicted. None however, imagined something similar hitting their own cities. When men liked Holmes ravaged the youth of the city and went about murdering people, no one at the time thought it could be the work of a serial killer. People were too innocent, even with the crimes that shattered their lives each day, they refused to believe something that heinous could be taking place right next door. A good example of this stint was the Broadway show titled ‘Chicago’ itself. It paints the story of Velma Kelly, a notorious criminal. In fact women were the only magnificent criminals in that show, while men played the part of protectors, lawyers, gullible husbands. The show was a satire on the state of things in the city. Woman has changed drastically, they were no longer thought of as naà ¯ve, innocent, noble creatures. They were scandalous entities.

Economics Of The Music Industry Economics Essay The Industry has reacted very badly to the consumption of CD sales. Many people blame the decline of CD sales on illegal file sharing and downloads but also to be considered is the way that CDs have been distributed and marketed over the last few years. Some of the reasons could include non competitive pricing of CDs, reduced number of shops stocking them and some of the major labels unwillingness to experiment with other form of entertainment industry such as video games and DVDs which hold a considerable force on the industry.  [1]  The competition from other media such as the gaming industry has also affected CD sales. EA (Electronic Arts) is incorporating music and cinema experiences into the games themselves  [2]  . Piracy through CD burning has affected the sales badly unlike other industries such as the software and gaming industry which is forever updating itself. The CD has been around for over 20 years now and the music industry has not been so fast to keep reinventing itself and has fallen behind in the technology race. Whilst Physical sales are falling there has been an increase of ticket sales at concerts and festivals and revenues have grown. In 2009 a report was released by the Performing Rights Society showing the retail value of recorded music fell 6% whilst live revenues grew 13%.  [3]  David Kusek describes this as a good thing for the industry as only 4 percent of records ever sold enough copies to break even.  [4]  The result in the increase of demand for live music could be down to the record industries obsession with marketing and huge profit margins and has gradually become detached from its artists and consumers. Where as generally live music promoters and agents have always been closer to the artists and their audiences  [5]   The relationship between artist, consumer and label is changing due to technology and the internet and this has affected the way in which music can be distributed. The relationship between the artist and label can be difficult. Music labels sometimes edit the artwork or the title of a song, much to the frustration of the artist. The artists have turned to the Internet and the role of labels is becoming increasingly diminished, as artists are able to freely distribute their own material through file sharing, web radio, and other peer to peer services, for little or no cost.  [6]  Bigger artists have ended their contracts. Radioheads problems with their label in 2007 ended with them releasing their album on their own and subsequently released as a pay what you want sales model as an online download.  [7]   The relationship has also changed between artists and consumers. Through the internet fans are now a lot closer to the favourite artists. For example, Tom Delonge, an American Rock musician created a website called Modlife.com which allows uses to connect to bands, artists and personalities using live video broadcasts, text messaging, video blogs, mobile updating and twitter feeds.  [8]   The digital transformation has had a huge impact in the way artist merchandise is sold. The internet can now be use to sell merchandise directly marketed towards the fans. Before the internet, merchandising was selling hats and shirts to a long queue of fans at a venue, but now products are directly related to current fashions and culture. For example Grindstore.com specifically directs is merchandise towards fans of rock music and states it is able to offer the most comprehensive range of male and female music merchandise from all over the world  [9]  Grindstore features clothing from bands such as Greenday, Metalica, Slipknot and Motorhead all in one place. Other similar companies such as the American based Hottopic.com are a multi million dollar company showing revenue over twelve months ending July 31, 2009 was $768,200,000, a 4.52% increase from the previous year.  [10]  This just proves the power of music merchandising and direct marketing using the internet. For the music industry it is a hard task safeguarding existing sources of income and finding ways of developing new ways of income. One solution to safeguarding the future of music industrys income is through a change in the way which music is licensed. One way might be through a small fee that allows users to freely download all music. This could be through a tax which is payable on media products such as mp3 players, Ipods etc or through a blanket licence similar to that of the British Broadcasting Cooperation which is charged to all United Kingdom households, companies and organisations using any type of equipment that can receive and play music. These possibilities could be created by the record companies or part government intervention. I think this will be one of the best ways to create a source of income as it is becoming increasingly harder to police the web for illegal downloads. Another possibility in creating a new source of income is to become more precise in which the PRS collects royalties through the advances of the internet by creating a framework. Currently royalties collected from restaurants for example rely upon human estimations and averages and no consideration is made for the diversity of music played in different types of venues. The use of digital technology could help this to be more accurate. To conclude, I have discussed how the UK music industry has reacted to current changes in consumption and distribution with specific analysis to how the industry has reacted badly to the decline in CD sales but the consumption of live music has increased. I have shown how direct marketing and merchandising by companies like grindstore.com is creating big profits for the music industry through the use of the internet. Through the changing relationships between artist, label and consumer I have shown how music distribution is changing and how due websites such as modlife.com fans are ever closer to their artists. Finally I have demonstrated ways in which the music industry can safeguard their revenues such as a blanket licence or by creating new ways in which royalties are collected.

The Treatment Of Youth Gang Members Criminology Essay Should Convicted Youth Gang Members Be Treated Like Other Juvenile Delinquents, Including Status Offenders? According to the National Gang Center, there is no single, generally accepted definition of a gang. State and local jurisdictions tend to develop their own definitions. The term street gang is often used interchangeably with youth gang as well as criminal street gang, with the latter explicitly denoting the element of criminal activity found almost universally in gang-related legislation (National Gang Center, 2011). There are different types of gangs, for example: There are Delinquent Youth Gangs which are considered as groups of young individuals, juveniles, who hang out and do everything together. The group will identify themselves with similar clothing, hand signals, or colors. They have engaged in delinquent acts or undesirable behavior such as truancy, status offenses or minor vandalism. Their behavior often warrants the attention of the local law enforcement, residents a nd the school system; but they have not reached the level of committing serious crimes. Traditional Turf Based Gangs are when groups of young people, juveniles and or adults, who have a known name and leader or leaders who identify themselves through clothing, hand signals, and colors. Turf Based Gangs usually associate themselves with a territory, which they defend against rival gang members. These gang members have engaged in such acts as vandalism (graffiti), assault, and in some cases homicide. Then there are the Gain Oriented Gangs which are groups of young people, juveniles and adults. They are similar to the Turf Based Gangs because they also have a known name and a leader or leaders. The individuals within this type of gang repeatedly engage in criminal activities as a group or individually for the sole purpose of economic gain. Gain oriented gang members will engage in offenses such as robbery, theft and the distribution and sale of a controlled substance. Lastly, is the Vi olent/Hate Gangs which are groups of young people, juveniles and adults with a known name and a leader or leaders. The Violent/Hate gang members collectively engage in criminal acts of violence towards groups or individuals, which is considered to be their primary motivation. Geographical turf, material and economical gain is secondary. The offenses that The Violent/Hate gangs commit are serious assaults and homicide. Youth Involvement in Gangs The 2004 National Youth Gang Survey issued data estimating that 41 percent of youth gang members were juveniles and 59 percent were young adults age 18 or older (Snyder and Sickmund, 2006, p.83). The age of membership for Youth Gang members is generally between the ages of 12 and 24 (Hess, 2010, p.200). There are many reasons why youth join gangs. One reason is the socio-economic background of the individual. Other reasons could be for attention, wanting to feel a part of something, peer pressure, financial gain, the feeling of being loved and accepted (something that they may not feel at home), and for protection. Children search for acceptance and attention from gangs who show a false sense of love by giving the child street status and an identity of their own. In return the child shows complete loyalty to the gang to the extent of disowning biological family members. Many parents have no clue that their child is affiliated with a gang. To combat the growing problem of youth gangs parents must become more involved with their childs day to day activities. Parents must educate themselves on the warning signs of gang activity. Parents should have an in-depth discussion of gangs and the harsh realities of living a life as a gang member, for example an extensive criminal record, prison, and death of friends and family. Juvenile Delinquents and Status Offenses A juvenile delinquent is a person who is under age, which is usually below the age of 18, who is found to have committed a crime in states which have declared by law that a minor lacks responsibility and thus may not be sentenced as an adult (Farlex, 2011) . However, the legislatures of several states have reduced the age of a criminal responsibility for serious crimes or for repeat offenders to as low as 14. Status offense is an offense committed by a juvenile that would not be a crime if committed by an adult. Some examples of status offenses are, truancy, running away, curfew violation, incorrigibility or endangering health and morals. Conclusion A convicted youth gang member should not be treated like a status offender or juvenile delinquent. (Hess, 2010, p.200) states belonging to a gang is not illegal in this country; however, many of the activities that gangs participate in are illegal. Gangs commit shootings, assaults, robberies and other violent crimes; engage in extortion and other felonies; traffic in drugs; and generally terrorize neighborhoods. Convicted youth gang members are aware of the crimes they commit and some consider it as a way of life. These crimes are substantially more serious than status offenses or delinquent behavior. I feel that offender based criteria should be the factor which control the decision-making process, be it the decision to directly file or transfer a juvenile offender to adult court for prosecution or the decision as to what sanction should ultimately be imposed if a juvenile offender is convicted. Gangs actively recruit membership in their early-to-mid teens to carry out violent and h einous crimes as a way to prove themselves to gang leaders and to increase their individual standing within the gangs hierarchy. Because many states mandate lesser penalties for violent juvenile offenders than adults, gang leadership often have juvenile gang members perform violent crimes towards others because there is less of an ability to prosecute them. While I strongly believe treatment, rehabilitation, youth gang prevention initiatives and after-school programs are important tools in addressing Americas gang problem, the ability to provide swift enforcement of violent juvenile offenders is necessary to keep our nations communities safe.

Theories of Management :: Buisness Management

Management plays a significant role in how business operates. The diversity of approaches to the theoretical and practical background of management has come up with versions of what is meant by such key words as management and organization. The academia views expressed in relation to management theories take a different role than that prescribed to managers. There has not been any concrete definition of management even though the classic definition of Henri fayol still remains contention to be the preferred choice after eighty years. In the context of what is required I will like to elaborate on the following journals which I will vividly explain in assignment two. David J. Lemak (2004) explains clearly the path through that management theory jungle and how entangled theories have brought about conflict and confusion. It recommends using management discipline rather than trying to meander our way through the jungle of numerous theories and â€Å"schools of thought†. This approach was set by koontz and it explains the discipline of management. David lamond (2005) also touched on how to absorb the past in order to understand the present and enlighten the future. According to (Leonard et al, 2004) they explored on how great ideologies turn to become great works. The paper also explains how Frederick Taylor â€Å"spread the gospel† of scientific management. It also sites example and explain how the theory of scientific management came to being and how it used in both private and public organisation. In addition, Amandi et al, (2004) makes us understand issues related to leadership decision and also gives a clear overview on leadership theories. It clearly makes us understands the difference between a manger and a leader as well as the behavioural and trait aspect of leaders. Sahadevan et al, (2004) explains grounded theory approach to analyze the quality of responses from authors and to gain in depth knowledge from the authors of great works that might be helpful to scholars and practitioners involved in the process of developing fresh understanding in organizations.

By using a technique known as Somatic Cell Nuclear Transfer, scientists at the Roslin Institute removed the nucleus from an oocyte (unfertilized egg), and then fused this newly enucleated cell with a donor cell (with complete nucleus). This new embryo was then implanted into the womb of a surrogate mother ewe. In total, out of 277 fused cells, 29 successfully developed into embryos, while only one of these resulted in a successful live birth (a total success rate of 0.4%) (Wong, 202). Hunting Should Not Be Outlawed Essay

Hunting should not be outlawed. It is still a source of food for people who still live off the land . Hunting can be a very effective method of population control. Hunting is a sport of tradition it offers recreation from everyday life. Hunting animals for food is better for people because it does not have all the hormones that farm raised animals have. There aren’t very many diseases that affect humans in wild animals. Majority of the animals that have seasons are edible. Hunting is a very effective method of population control. If too many animals of one species or several related species live in one area they could possible wipe out there entire food source or sources. Then many of them would starve to death which unknown to the tree huggers that want to stop this is a very painful death, being shot is a very quick painless death. Hunting can save an ecosystem and entire species, by killing some of the animals in the ecosystem you can save the food source for the animals still left living. Hunting is a tradition in most of the world. People have been hunting for tens of thousands of years. Many people still use hunting as their many food source throughout the world. It is also a recreational activity. Tradition’s should not be outlawed. Hunting can help save the environment in which they live in by population control. It is a source of food. It’s an activity that people have been using to get away from society as we know it for several years. In conclusion Hunting should not be outlawed.

Over the past decades, the world has witnessed different changes that have affected countries and continents. The way economics activities and business are conducted in the world poses challenges and opportunities. Technology is one of those changes or development that has occurred over decades. In a way, technology has changed every aspect of human life. In generally, it has change the ways businesses is conducted. Now, people do not need to see face-to-face in other to conduct business.Businesses can be conducted at home, long distances, in plane and through online real-time. In the education and business environment, technology development has been major catalysts that influencing the way activities are conducted. However, book business is our major focus. In this paper, we are going to analyse the effects of technology development on book business in the next 10years. Through the past technology age or years, we could analysis effects of technology on businesses and nations. Tech nology has replaced the use of human in industries by machines or robots.Before the advent of technology into businesses human has been the main source of labor for entrepreneurs but in the world today, it is apparent that machines have taken over. Availability of new and old information has been made possible through these changes or development in technology. Through this information, there exist different options of communicating and performing tasks and jobs. Moreover, people now prefer to get information through the internet rather than getting it from its source (most times the hard copy).People prefer to read book, novel and articles online rather than getting the hard copy to read. In a way, these have affected publishers, writers in the way they conduct their businesses. This has affected the rewards writers, editors and publisher makes from their jobs, since there works are published online at a reduced cost and most time they do not enjoy these rewards. In few years time, innovations of several types are to be expected. Precisely, in the next 10years new technologies would be introduced into the book business.These new technology will add to the existing ways of conducting or doing the business and will bring fundamental changes into the way book business will be conducted. However, in 10 years time technology will continue to influence the book business in terms of advertisement, sales and production. The effects of technological development will either be positive and negative. For instance, it will reduce the number of people that will be employed by industries that produce books.This in its own way will increase the unemployment rate and leads to decrease in standard of living of people. This is an example of the negative consequences that will be caused by development in technology. On the other hand, it will increase profitability of those in the business. Since, the workability of book business will require few amount of finance. Therefore, c ost of production will reduce since there is an innovative way of organizing the business, consequently leading to increase profit.In conclusion, in years to come various innovations will evolve in business and determine the way business will be conducted. Technological developments have continued to influence the way we live, conduct business and carrying out jobs. In addition to my work experience, I have strong communication, customer service, office, and administrative skills and understand with the education theory from some of my modules I completed and have so much passion for the hospitality/tourism field. Kathy lacked sufficient emotional intelligence to be effective in her new project manager assignment by Self awareness: Kathy had a deep understanding of her strength not her weakness to have time to talk to her staff. There was also lack of empathy as she failed to have the â€Å"ability to recognise the feelings and expectations of others and take them into consideration† as they were also local residents. Poor relationship with the staff resulted to â€Å"a campaign of passive resistance to her leadership†. 2. The element she exhibit successfully were: †¢Motivation: although the project became quickly bogged due to poor performance she still managed to motivate herself and â€Å"pushed her team hard†. Also by settling goals for staff and senior members of the project to â€Å"work long hours† to accomplish important milestones in order to complete the assignment. B. Main methods of communication include: Verbal communication either through sound, work or speaking to other members of the project or recorded clips of the senior members. Also Written communication either emailing or letters with the use of computers and internet for emails. In addition visual communication through graphs from excel or video clips on YouTube or television therefore contributing to the IT and applications. C. 5 Traits of emotional intelligence me: Self awareness: In high school was given a presentation on Kidneys, a sensitive topic managed to trust my intuition& took control of my emotions as that was my weakness. Self regulation: one of my cousins used my bag without asking, i had to think of how I was going to talk to them instead of fighting. Motivation: When given 2 or more assignments during college treated myself if i finished a day before the deadline& the days increased as the year progressed. Empathy: when my friend lost her job& i had just got a job I helped her with some of her bills as I had been in a similar situation before. I would recommend Virgin to promote this idea to over airlines; this should work because although they are taking into account global warming they are reducing expenses which n turn will lead to an increase in profit. Related to your chosen organis ation, select 2 stakeholders and explain the relationship between these stakeholders and the organisation. I have chosen to work on the relationship between 2 stakeholders in Virgin Atlantic; these stakeholders are the employers and the employees who work for the organisation.The relationship between these stakeholders and the organisation is tied to the success of the business e. g. In task 3 I talked about why staff leaking information to the media would affect the customers, this is because the customers in this case who were people in the public eye did not want the public to know when or where they were traveling. This concerned the customers; if you are making your customers concerned about their safety then they are less likely to use your organisation which in turn will mean a loss of profit.I thought of a solution to try and prevent this from happening again, the idea was to find out information about potential employees at the interview stage, and to offer good incentives for employers who report these people, this act would also let them know that leaking information has been an issue and might make them think twice about doing this in the future, in my opinion the more you make your staff aware about these issues their is less chance of them reacquiring. Evaluate how the suggested changes and suggestions on ethical practice will impact on the stakeholders and the business.I think with staff signing more legal documents and training staff to look out for people not complying with company policy and offering incentives for them to catch these people, will lead to the customers preferably upper class customers gaining more trust when using the airline, because their has been some bad press about the information leak, it has had a knock on effect on the image of the business and now Virgin needs to put the trust back into the business. McKinsey Consumer and Shopper Insights June 2012 Standing Tall: Japan’s Resilient Luxury Market Brian Salsberg Naomi Yamakawa Photograph: Abbie Chessler 2 In the immediate aftermath of the tsunami, earthquake and nuclear disaster that hit Japan last year, killing 19,000 people and battering the nation’s already shaky confidence, it was hardly surprising that people didn’t feel like shopping. At the time, the conventional wisdom was that such restraint was likely to last.People would still have to shop for essentials, of course, but the market for things like high-fashion apparel and luxury handbags was surely bound to suffer long-term damage. Such thinking made eminent sense – except it didn’t happen. Fifteen months on, today’s luxury market looks a lot like the luxury market that existed the day before the Great East Japan Earthquake, much as we anticipated in last year’s report. 1 Our findings at the time were necessarily tentative, coming as they did less than three months after the disasters.Today, we can assert this with more confidence. When asked if the disasters had changed their attitudes, for example, fewer than 20 percent of the 1,450 Japanese consumers we interviewed were less interested in shopping for luxury goods than they were before the disasters (Exhibit 1). The Cabinet Office’s Consumer Confidence Survey report from May 15, 2012, shows that consumer confidence has risen strongly since March 2011 (to 40. 3) and is back to up to levels last seen in 2010. Moreover, in a small but telling sample, when we asked 20 Japan-based luxury company CEOs about their sales outlook, every single one said 2012 would be better than 2011, and almost three-quarters said that the disasters of 2011 had no effect (63 percent) or, counter-intuitively, had a positive effect (10 percent) on company performance. Japan’s luxury market rings up between $10-20 billion a year in sales (depending on how the market is defined).That figure is unlikely to grow much, given Japan’s shrinking population, slow economic growth, and cost-conscious consumer attitudes. Strictly from a sales ratio perspective, Japan’s luxury market will continue to wane in importance for most luxury manufacturers. A case in point is LVMH. By 2011, the figure had dropped to 8 percent (and that marked an improvement from 2010).Compare that performance with the rest of Asia, where the company’s sale share rose from 17 percent to 27 percent over the same period. 3 And yet, such figures make it easy to lose sight of one simple reality: Japan remains the world’s third-largest luxury market, after the US and China. more high-end brands than cheaper brands. Not surprisingly, their spending on luxury is not as high as for other age groups, but a higher percentage of them are active in the luxury market (5 percent compared to 2. 3 percent of those age 50 and up).This cohort are more likely to be willing to pay full price and are also more likely to see owning luxury goods as something special. As for men, while they make up a minority of luxury shoppers in Japan, they have stayed more loyal to expensive brands. There are an estimated 3 million men under the age of 34 living alone in Japan. According to government data, average incomes for this group increased by 7 percent Exhibit 3: in 2011, and their spending jumped by 13 percent. Compare this to single women, whose spending grew less than 2 percent, and the average Japanese consumer, whose spending dropped. Young men, it seems, saw the M arch 11 disaster as a good reason to live for the moment, and Japan’s luxury goods market appears to be a beneficiary. Finally, when we look at segmentation by income, Japanese who spend more than a million yen (about $12,000) a year on luxury goods are more than three times as likely to say they are switching to high-end brands than to low-end brands (Exhibit 3). Those who spend less than half as much are reporting the opposite. What we learned Here are some of the most striking insights from McKinsey’s 2012 Luxury Consumer Survey: ?Japan is a market of markets That is, some niches and segments are more promising than others. In terms of products, for example, highend Swiss watches, such as Rolex, Omega, Piaget, and TAG Heuer, have reportedly enjoyed significant growth in the past year. 4 Why? Because luxury consumers seek both emotional and functional benefits. A great watch, they believe, is the kind of item that appreciates in value and can be passed down to the ne xt generation. In terms of behavior, there is opportunity on the sales floor.For reasons that range from a more stable economy to better upselling skills, consumers are trading up in some luxury categories, even as they trade down in others – primarily apparel and similar categories with shorter shelf-lives and greater selections of alternatives. Demographically, younger consumers and men are worthy of particular attention. Experience is increasingly valued The in-store experience is a key element in enjoying luxury, and it may be particularly important in Japan, whose customers are renowned for their high service standards.Asked what were the key elements that enhanced the buying experience, the top two answers Japanese consumers gave were: 1) The staff was kind, and 2) The staff was knowledgeable. Responses were consistent across categories. Luxury executives tell us that for their best customers, the in-store experience and overall customer relationship are nearly as important as product performance. Luxury brands, by definition, are about high quality and exclusivity; providing an excellent customer experience helps to deliver something extra, and those we spoke with are convinced that doing so is well worth the investment.One executive told us that his company, a luxury automaker, saw tremendous value in closely monitoring the daily cust omer relationship management activities of its sales team and using the information to coach staff, not only on closing a sale, but on upselling various options and features. The value of experience also comes through in what consumers tell us they want. There is clear potential for luxury experiences to become â€Å"the next big thing. † Asked their level of interest in various products, those 30 and up named luxury hotels above all others (it ame in second among those in their 20s). Spas and beauty services also scored highly (Exhibit 4). We also asked one of our favorite questions from previous surveys: â€Å"Imagine you won 300,000 yen (about $3,800) in a lottery today. How would you spend it? † Except for those in their 20s, travel scored highest by a decisive margin (Exhibit 5). ? Digital marketing in Japan has far to go Even the executives we spoke to agreed with this. More than twothirds of them admitted that luxury brands have been â€Å"less successful† Exhibit 4: n capturing the changing behavior of consumers, and just 15 percent called online sales a â€Å"meaningful† part of their business in Japan. At the same time, 90 percent said online marketing and promotion was â€Å"somewhat† or â€Å"very† important. A look at the demographics confirms that digital complacency would be a mistake for most luxury players. The level of customization on luxury performance cars has hit a recent high this year: this is where all the money is made. â⠂¬ Ã¢â‚¬â€President, luxury car manufacturer to use digital means on their Consumer Decision Journey;6 this matters because women account for about 75 percent of luxury sales in Japan. For another, almost 16 percent of 20-somethings who had a smartphone or tablet had used it for their last luxury purchase, compared to 5 percent for over-50s; and a full 75 percent of younger consumers had used their device to check prices (Exhibit 6).Capturing the younger consumer is vital, given the looming cloud that is Japan’s relentlessly aging society. As established brands strive to ensure they remain relevant to Japan’s technologically-oriented young people, it is plausible, even likely, that a digital component will be central to those efforts. Likewise social media cannot be ignored. A February 2012 Nikkei survey of Japanese smartphone users showed that about 80 percent of women in ther 20s and 30s, 80 percent of men in their 20s, and 60 percent of men in their 30s and 40s us e social media. 7 ?Old-school rules – by default Because the luxury experience is so important, it stands to reason that both sexes and all ages strongly prefer to do their high-end shopping in person. They still like it best of all in department stores (Exhibit 7). It would be a mistake, however, to conclude that the department store format is thriving. On the contrary: while the sheer number of department stores in prime locations all but guarantees a large audience of shoppers, the tired format has yet to find its place in today’s more dynamic, user-friendly retail landscape.What it all means Based on this research and our experience with many retail clients, we have identified several important implications. ? Own the interplay between digital and in-store touchpoints and embrace social media Just a few years ago, at one of McKinsey’s annual luxury leader dinners in Japan, the consensus in the room was that social media and Exhibit 6: luxury were mutually ex clusive. After all, the thinking went, social media is inclusive by definition, and luxury is exclusive.Today, companies like Burberry are demonstrating just how backward and self-defeating that thinking was. Burberry boasts 12 million Facebook followers, 800,000 Twitter followers, and 12 million views on 250 different YouTube videos. Tiffany & Co. has also embraced digital media, with a highly regarded e-commerce site, Facebook presence, and even an iPad app showcasing its famous line of engagement rings. A key to succeeding in social media is to deliver the brand story and heritage consistently across media while tailoring messages to the specific consumer segments that are using each media format.It’s also important to understand the role each medium plays in the Consumer Decision Journey. For example, in cosmetics it can be easier to introduce cosmetic routines (e. g. , how and in what sequence to apply the product) in store, but consumers often seek out additional information and reviews online. For apparel and accessories, customers may go to the store to buy, since they want to be able to touch items and try them on. The initial introduction and attraction often happens outside the store â₠¬â€œ from storefronts, wordof-mouth, or magazines.Winners will be those who can excel at multichannel marketing and sales. ? Make the most of travel retail Japanese consumers love to travel – up to 20 percent of all luxury consumers have shopped abroad in the past 24 months (Exhibit 8). This accounts for the crucial role of dutyfree shops, where a third of luxury consumers have shopped in the last year. Women are particularly prone to stopping by duty-free, with 36 percent of them buying there. As a result of international travel and the Internet, consumers today know what luxury goods cost both inside and outside Japan, and they ay be timing their shopping to take advantage. This is especially poignant for luxury manufacturers – they need to recognize that the consumer relationship with any given brand crosses international borders. That fact has implications for after-sales service, and underscores the importance of maintaining consistency with the face of the brand across both channels and geographies. For a number of years, we have been observing the emergence of â€Å"global tribes†, that is, groupings of consumers who have more in common with their counterparts in other geographies than with their fellow countrymen.Easy access to social media and cheap travel will only deepen this phenomenon. In response, luxury manufacturers will need to do much more than simply accept that today’s consumers are global; they will need to make their brands even more so. ? Manage parallel imports Parallel imports – identical products imported from a foreign country, then sold for much less – cannot be prevented, but can be managed. Some brands are trying to restrict parallel imports by tracking serial numbers to determine where the imports are coming from, and decreasing Exhibit 8: argins for retailers who are caught. Others are putting limits on aftersales services available to parallel imports. Few companies have chosen to move to one global, exchangeadjusted recommended retail price, though that may become a more standard approach. ? Embrace customization and made-to-order luxury Building off a trend popularized by other consumer-goods companies, such as Adidas and Nike in sports footwear, luxury auto manufacturers, and luxury handbag and accessory players are embracing customization.This is consistent with a broader consumer trend in developed markets (the â€Å"My† generation) where niche is replacing mass in many areas and consumers have grown used to customizing everything from their playlists to their iPhone covers. Luxury has always been synonymous with exclusivity, but with so many stores and so many new channels to buy from, we have begun to see a â€Å"commoditization† of exclusivity. In a sense, then, customization is the ultimate in exclusivity. Some luxury carmakers tell us their strong revenue growth in Japan has come not because they are selling more cars, but because buyers are loading up on various bells and whistles to create their own personalized, ideal vehicle. Of course, customization comes at a cost to luxury manufacturers, adding complexities to the supply chain and bey ond. It must be reserved primarily for truly high-end products. the number of car-sharers has increased 10-fold, to 170,000, and revenues ould surge to $550 million by 2016, according to estimates from Frost & Sullivan. 9 This shift to value is real and enduring. So, we believe, is the emphasis on discretion. In the wake of the earthquake, the percentage of those who said that showing off luxury goods was in bad taste rose sharply, from 24 percent to 49 percent; this year, it was 51 percent. The quest for value and a desire to avoid the appearance of conspicious consumption are not necessarily antithetical to an appreciation of luxury. These attitudes can co-exist.In fact, that precisely describes the state of the Japanese market: Consumers are ready, willing, and sometimes eager to buy. Conclusions Only a little more than a year after the worst crisis to hit Japan since World War II, the Japanese luxury market is stable.Ultimately, it comes down to this: despite deflation and disaster, Japanese consumers continue to want luxury goods and to buy them at a good clip. But – and this has been true since the financial crisis hit in 2008 – they are more cautious about price and more demanding. They do not just want an expensive product to look great and to work beautifully, but to satisfy other needs, whether emotional or even social. Half of luxury car buyers, for instance, say that â€Å"eco-friendliness† is important to them (Exhibit 9). The quest for value, in all its forms, is becoming characteristic up and down the retail chain.As we argued in the McKinsey Quarterly in 2010, many co nsumers have diverted a chunk of their spending away from high-priced prestige. 8 Wal-Mart, Amazon, Costco, Ikea, Daiso, Uniqlo, private-label foods, and the low- to middle-end specialty apparel players are all doing conspicuously well. Then there is carsharing – short-term rentals by the hour. This service barely existed in 2009 (revenues were about $17 million). Today it has become positively mainstream. In the first four months of 2011, sales at department stores were up more than 30% compared to 2010. 2 This continues an established trend, as last year’s report on the market showed (see report at csi. mckinsey. com: â€Å"Living it up in luxury. †) Still, insiders are asking whether it can last. For one thing, according to McKinsey’s survey, the percentage of household income that luxury consumers spend on luxury is already higher in South Korea (5%), than in Japan (4%)3—and the Japanese luxury market has been stagnant in recent years.Moreover, the performances of famous brands in Korea ha ve been mixed. For example, LVMH and Ferragamo continued to do well, but others, like Gucci Group and Dior, saw sales drop in real terms in 2010. 4 1 2 3 4 5 6 Thus, while the headline news is that the luxury market is still growing strongly, uncertainty is also mounting. In this year’s report, McKinsey addresses these concerns, which come in the form of three key questions: Can South Korea keep it up? What’s changing?And what do these trends mean for the players in the luxury industry? To answer these questions, for the second year in a row, McKinsey surveyed 1,000 Koreans who had purchased at least 1 million Korean won ($930) in luxury goods in the previous year across four categories —fashion apparel, leather goods, shoes, and watches/jewelry. Among the respondents were 200 â€Å"heavy purchasers†Ã¢â‚¬â€those who had spent at least 10 million Korean won ($9,300). We also interviewed 24 senior executives of luxury-goods companies. Here’s what we found. 5Let’s start with the proposition that not all consumers are created equal; to a startling degree, it is mainly the heavy purchasers who are keeping the Korean luxury market rolling with such force. For example, Lotte department store estimated that the number of â€Å"Most Valuable Customers†Ã¢â‚¬â€those who spend 15 million won ($14,000) or more a year—rose 14. 4% in 2010, compared to 9. 2% for other kinds of luxury consumers. The number of VIP customers at Shinsegae department store —those who spend more than 8 million won ($7,400) —grew 35%, compared to 12% for other consumers. 6 Shopping at the high end also appears to be habit-forming.McKinsey found that heavy purchasers are much more likely to say that they enjoy their goodies â€Å"as much as I always have† vs. non-heavy customers (33% to 12%). This difference in attitude was reflected in their actual spending: The big-spenders indicated that they had spent more on all four luxury categories in the previous 12 months.
